Terms and Conditions

Your order is subject to the following terms and conditions (unless you have made special arrangements directly with us). These may change from time to time, but your order will be subject to the version of the terms and conditions on this Website when you place your order.

 

Pearson offers a range of online products and services. These terms and conditions apply to all online products and services in addition to the terms shown at their respective sites. If there is a conflict, the respective sites’ terms shall take precedence. Some subscription products are offered in different versions, or as a menu consisting of components that you may select. In this case, the prices and conditions are as set out in the specific terms. In the event that you require us to provide any additional training and/or consultations or additional content packages, you agree to pay for these at our then current rates; and they will be subject to the respective terms and conditions (as amended from time to time).

 

1.Your order

We will do our best to fulfil your order, but we cannot guarantee it.

 

Where we make the product available to you through a third party fulfilment provider, we may provide you with an electronic redemption code that will allow you to download the product from the third party site. The third party site may require registration and may require you to accept their terms and conditions, which will apply to your use of the site and our product through it. The electronic redemption code will not be valid for redemption indefinitely. You should redeem it as soon as possible after receiving it, and you accept that it may expire if you do not redeem it within 180 days of reception.

 

Each individual purchase is for use only by the person who bought the item.


2. Price

The Pearson Education Limited VAT registration number is GB278 5371 21. Prices are as stated from time to time on this Website and are subject to change without notice. If there are any post and packing charges, these will also be indicated separately on the invoice you will receive on supply/with the goods or on your digital receipt.

 

The price stated on our Website is inclusive of any applicable value added or other sales tax. We will show a breakdown of sales or value added tax (as applicable) applied to the whole order in your invoice and on the purchase summary page before you confirm your order. 

 

This Website is based in the UK and we are making sales from the UK. Although the prices on the Website are in your local currency, because we are based in the UK, your bank may treat a purchase on this Website as an overseas transaction and charge you a fee for an overseas transaction in addition to the purchase price. 

 

We have no control over whether your bank will charge you any such fee or its size. You are responsible to pay any such fees and we are not liable for them.

 

3. Payment

All credit/charge card payments are subject to authorisation by the card issuer. If your payment is not authorised, we will cancel your order (and notify you that we have done so).

 

Online resources or digital files for download, or similar services, will only be made available to you once your payment has been authorised, unless we have agreed credit terms with you.

 
4. Cancellation and Returns

By submitting your order, you agree that we may process your order and begin the service immediately. If you are a consumer, you have a statutory right to cancel your order and obtain a refund, but this is subject to the following condition:

  1. You may only cancel your order for a refund if you have contacted Pearson within 14 working days after you have completed your online purchase.

 

Please notify the Customer Service team elearning.in@pearson.com if you wish to cancel your order, or to request a refund for a product or service.

 

If you are unable to complete the download process or wish us to provide a replacement for a file that is defective, please contact our Customer Service team elearning.in@pearson.com. Where this is due to our default, we will replace or refund the download. Where we use a third party fulfilment provider to give you access to a product, we may direct you to their customer services team.

 

5. DRM

You acknowledge that all our electronic products such as eBooks include security technology, which ensures that they may only be used in accordance with the applicable licence rights. These licence terms can be viewed at http://support.vitalsource.com/kb/bookshelf/eula.


6. System requirements

By submitting your order, you agree that we may process your order and begin the service. We will process your order upon receipt, but we do not guarantee immediate response or availability of service. You are responsible for all hardware, software, network availability and Internet connectivity required to access and/or use the product. We will provide you with a specification of the hardware and software required to use a product on request.

  

7. Permissible Uses

The following terms apply to software and other electronic products ordered through our Website, except where we provide access to the product through a third party fulfilment provider. In that case, the terms of use of the fulfilment provider will determine how you can use the product – and those terms may be different from these below. 

 

YOU MAY 

  • Download a product if you purchase the right to do so from us.
  • Subject to the terms of any third party fulfilment provider (where applicable), use a copy of the product on up to two devices (such as a computer, mobile device, tablet or other device) at the same time. If this device is linked to a network then the product may only be installed in a manner such that it is not accessible to other machines on the network.
  • Subject to the terms of any third party fulfilment provider (where applicable), transfer the product from one device to another, provided that you only use it on up to two devices at any one time. 

 

YOU MAY NOT 

  • Re-sell, distribute, forward, rent or lease the product or any part of it.
  • Copy any part of the product, except where specifically indicated otherwise or for back-up purposes.
  • Reverse engineer, decompile or disassemble the product or convert it into any other format or medium.
  • Use the product on more than the allowed number of devices.
  • Make changes to the content of any product except where we expressly allow you to do so, and then only to the extent that we have permitted.

 

All content and software supplied to you through this Website is our property, or that of our affiliates, or of third parties who have granted us rights – and it is protected by United Kingdom and international copyright laws.

 

8. Discontinuation of Service

We may decide to discontinue this Website, or any part of it, or make substantial changes to it at any time. We are also not obliged to provide all support services indefinitely. 

 

9. General

Although we try to ensure that the information we provide on our Website and in our products, goods and services is correct, it is provided on an 'as is' basis, without warranties or representations of any kind. No warranty, representation, conditions or other term, express or implied, is given that any of the content is accurate, complete or up to date. Pearson does not accept any liability for any error or omission of any content on this Website, in any product, goods or services, including content provided by us or any affiliated entities or by any users or other third parties.

 

We do not make any representation, or give any warranty or undertaking; and to the full extent permissible by law we expressly exclude any and all representations and warranties whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and correspondence with description, or of the products/services not being defamatory, injurious, obscene or unlawful or of non-infringement of any intellectual property or other third party rights, whether implied by statute, common law, custom, trade usage, course of dealing or otherwise. We do not exclude any liability in respect of death or personal injury caused by our negligence, liability for our fraud, or any other liability that we cannot exclude by law. 

 

We cannot guarantee and do not promise any specific results from use of any product, services or goods sold through this Website.

 

We will have no liability to you for any failure to deliver goods or services you have ordered, or any delay in doing so, or for any damage or defect to services or goods delivered that is caused by any event or circumstance beyond our reasonable control.

Use of this Website and any product or service ordered through it and any content on any part of it, whether requiring registration and/or subscription, or not, is at your own risk. Pearson will not be liable to any users of this product (whether registered users, subscribers or not) and any third parties for any claims or losses of any nature including, but not limited to, loss of profits, direct, indirect, special or consequential damages arising from a user’s or third party's use or inability to use any product or service or any part of it, including any loss of data or lost profits or wasted time of management or employees - even if Pearson is aware of or has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained in these Terms of Use, Pearson’s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us.


If, for any reason, part of these terms and conditions is unenforceable the validity of the remaining terms and conditions shall not be affected.

You are not permitted to remove or amend any trade mark, copyright or other proprietary notice on any of our products. You acknowledge that all rights in and to any and all copyrights, know how and other intellectual property rights relating to our products are and shall remain our property (or that of our licensors). You will not at any time do, or cause to be done, any act or thing which impairs or infringes those rights.

These terms and conditions and all contracts under these terms and conditions are governed by and shall be construed in accordance with the laws of England and all disputes shall be submitted to the exclusive jurisdiction of the English courts unless national mandatory law states otherwise.
